You may use the Service only if all of the following are true.

• you are at least 16 years old, or if you are younger, you have valid consent from a parent or legal guardian
• you have legal capacity to enter into binding agreements
• your use of the Service is not prohibited by applicable law

We may refuse access to any person, account, device, or region at any time.

The Service provides language-learning and educational functionality, including but not limited to the following.

• AI-generated texts
• translations
• grammar and vocabulary explanations
• reading tools
• classroom and teacher-sharing functionality
• personalized content
• subscriptions and premium features

We may add, remove, modify, restrict, suspend, discontinue, or replace any feature of the Service at any time, with or without notice.

We do not guarantee that any feature, content, account, export, link, or shared material will remain available permanently.

The Service is intended solely for informational, educational, and language-learning purposes.

The Service and any AI-generated output do not constitute legal, medical, psychological, educational, professional, financial, or certified translation advice.

You remain solely responsible for reviewing and verifying all generated content before relying on, publishing, sharing, assigning, teaching, or otherwise using it.

To use certain features, you may need to create an account. You agree to provide accurate and complete information, keep your credentials confidential, notify us immediately of unauthorized use, and remain responsible for all activity under your account.

You may not share, sell, transfer, or lend your account, create multiple accounts to circumvent restrictions, or impersonate another person.

We may suspend, restrict, disable, or terminate your account at any time, with or without notice.

You may upload, enter, create, submit, import, export, share, or otherwise process text, prompts, notes, exercises, vocabulary lists, files, screenshots, comments, or other content ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, transmit, display, adapt, modify, and use the User Content solely as reasonably necessary to operate, improve, secure, support, and provide the Service.

You acknowledge and agree that content generated through the Service may be shared through links, exports, screenshots, copies, or similar features.

You are granted a limited, non-exclusive, revocable right to share AI-generated texts, vocabulary lists, exercises, and similar educational materials with students, classrooms, teachers, tutors, and intended recipients for personal, educational, tutoring, and classroom-related purposes.

You may not resell, sublicense, republish, commercially exploit, mass distribute, or use generated content to operate a competing service without our prior written consent.

If you share content with students, classrooms, or other recipients, you are solely responsible for ensuring that the shared content is lawful, accurate, appropriate, age-appropriate, and does not infringe the rights of any third party.

If you use the Service as a teacher, tutor, school, educational institution, or similar organization, you are solely responsible for ensuring that you have all necessary permissions, notices, consents, and legal basis to upload, process, store, share, or distribute any student-related information or educational materials through the Service.

Teacher features may permit you to upload, store, or use limited student-related information solely for contact management, sharing, and classroom history purposes, including names, contact details, group names, preferred contact method, and records of materials previously shared with a particular student or group. You agree to use only the minimum amount of student-related information reasonably necessary for those purposes.

You must not upload or store special category personal data, medical information, government-issued identifiers, financial information, passwords, disciplinary records, or other sensitive information relating to students unless strictly necessary and legally permitted.

If you create or distribute shared links, classroom materials, exported content, or similar functionality, you are solely responsible for ensuring that only intended recipients have access. Shared links may be accessible by any person who obtains the relevant link unless additional access restrictions are used.

We recommend that teachers and educational users use pseudonyms, initials, student IDs, or anonymized information wherever reasonably possible.

You may import, upload, or process text through the Service only if you have the legal right to do so and to have such text stored, analyzed, transformed, processed, shared, exported, and used through the Service.

You must not upload, submit, share, or process through the Service any content that does any of the following.

• infringes copyright, trademark, database, trade secret, privacy, publicity, or other rights
• consists of books, articles, worksheets, course materials, exam materials, song lyrics, translations, educational materials, or other protected works unless you have all necessary rights and permissions
• contains confidential or proprietary information of another person or organization
• contains personal data, health information, financial information, passwords, passport numbers, government-issued identifiers, information about minors, or other sensitive information unless strictly necessary and legally permitted
• is unlawful, threatening, abusive, discriminatory, obscene, defamatory, misleading, fraudulent, hateful, violent, or otherwise objectionable
• contains malware, viruses, or malicious code

You must not upload or share through the Service any student grades, evaluations, attendance information, disciplinary information, health information, financial information, passwords, government-issued identifiers, or other unnecessary or sensitive student-related information. Student names and contact details may be used only to the limited extent reasonably necessary for contact management, sharing, and classroom history features and only where you have all legally required permissions, notices, and lawful basis.

You must not use the Service for unlawful purposes, reverse engineer, scrape, copy, exploit, or interfere with the Service, use bots or automated means in a manner that harms the Service, circumvent technical restrictions or subscription limits, use the Service in violation of export controls, sanctions, or applicable law, or use the Service in a manner that would cause us to violate applicable data protection, privacy, educational, consumer protection, child protection, or similar laws.

You are solely responsible for ensuring that you have all necessary rights, permissions, and legal basis to submit, upload, share, or process any content through the Service. We do not review all User Content and are not responsible for determining whether User Content is lawful, accurate, non-infringing, or suitable.

Users may only upload, import, process, share, or export content through Palabruno if they have the legal right to do so.

This includes any right necessary to store, annotate, transform, share, or export the content through the Service.

Users must not use Palabruno to process copyrighted books, articles, worksheets, course materials, exam materials, song lyrics, translations, or other protected works unless they have the necessary rights or permissions.

Please include:

• your name and contact information
• a description of the copyrighted work
• a description or link identifying the allegedly infringing content
• a statement that you believe in good faith that the use is unauthorized
• a statement that the information you provide is accurate

We may remove or restrict access to content, shared links, exports, or accounts where reasonably necessary to investigate or address alleged infringement, enforce our Terms, or comply with legal obligations.

Repeat or serious infringement may result in suspension or termination of access to the Service.

Certain content provided by the Service is generated automatically using artificial intelligence. You acknowledge and agree that AI-generated content may be inaccurate, incomplete, misleading, offensive, biased, or unsuitable; contain errors in grammar, language, facts, law, culture, or context; resemble content created for other users; or fail to meet your expectations or intended purpose.

To the maximum extent legally permitted, we make no representations or warranties regarding AI-generated content, do not guarantee that generated content is accurate, complete, original, lawful, or fit for any purpose, and are not responsible for any educational, academic, professional, legal, linguistic, commercial, or other decisions made based on AI-generated content.

Any use, publication, classroom distribution, sharing, or reliance on generated content is entirely at your own risk.

The Service, including its software, design, interface, branding, names, logos, graphics, text, layout, functionality, and all materials other than User Content, is owned by us or our licensors.

You receive a limited, non-exclusive, revocable, non-transferable license to use the Service for personal, lawful purposes, including limited educational and classroom-related use.

Except as expressly permitted in these Terms, you may not copy, reproduce, distribute, modify, sell, sublicense, or create derivative works from any part of the Service without our prior written consent.

Certain features require a paid subscription. Subscription prices, billing intervals, available features, and offerings may change at any time.

Unless otherwise stated, subscriptions renew automatically, you authorize the applicable payment provider to charge you, and you are responsible for cancelling before renewal.

If you subscribe through Apple App Store or Google Play, billing, cancellation, and refunds are governed by the rules of the applicable platform.

To the maximum extent legally permitted, all fees are non-refundable except where required by law.

We do not guarantee that the Service will be uninterrupted, secure, error-free, available in every country, or compatible with every device.

We may interrupt, restrict, or suspend the Service at any time for maintenance, security, legal, or commercial reasons. Temporary interruptions do not entitle you to compensation.

We reserve the right, but not the obligation, to review, monitor, filter, block, remove, preserve, investigate, or disclose content and information where reasonably necessary to comply with law, enforce these Terms, protect our rights, users, or third parties, or investigate abuse, infringement, fraud, or security issues.

You may stop using the Service at any time. We may suspend, restrict, or terminate your access immediately, with or without notice, if you violate these Terms, we suspect unlawful activity, infringement, abuse, fraud, or security risks, or continued operation becomes technically, legally, or commercially impractical.

Following termination, your right to use the Service ends immediately.

To the maximum extent permitted by law, the Service is provided "as is" and "as available".

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, and reliability.

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages; loss of profits, business, data, reputation, goodwill, opportunity, or expected savings; or any loss or damage resulting from your use of or reliance on AI-generated content.

Our total aggregate liability shall not exceed the greater of EUR 100 or the amount paid by you to us during the previous 12 months.

To the maximum extent permitted by law, we are not responsible for the lawfulness of student-related data uploaded by teachers or educational users, the adequacy of permissions, notices, parental consents, or legal basis obtained by teachers, schools, or educational institutions, unauthorized access to shared links, exported materials, or classroom content where such access results from the manner in which a user created, shared, or distributed such content, or any loss, claim, complaint, investigation, or regulatory action arising from a teacher's, school's, or educational institution's use of student-related information through the Service.

All claims relating to the Service may be brought only against Valentin Zach e.K. as the contractual provider of the Service and not personally against its owner, employees, contractors, representatives, or affiliates, except where mandatory law provides otherwise. Nothing in these Terms excludes liability that cannot legally be excluded.

You agree to defend, indemnify, and hold harmless Valentin Zach e.K., its owner, contractors, service providers, and affiliates from and against any claims, demands, proceedings, damages, losses, liabilities, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or relating to your User Content, your use of the Service, your violation of these Terms, your infringement of intellectual property, privacy, confidentiality, or other rights of any third party, or any claim that content submitted, uploaded, or shared by you was unlawful, unauthorized, infringing, or otherwise improper.

These Terms are governed by the laws of Germany, excluding conflict of law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

To the extent legally permitted, the exclusive place of jurisdiction shall be Straubing, Germany. If mandatory consumer protection law in your country grants you additional rights, those rights remain unaffected.

We may modify these Terms at any time. The updated version becomes effective when published. Continued use of the Service after changes constitutes acceptance of the updated Terms.
